Adult Dependent Relative Visa Requirement

The Adult Dependent Relative Visa route is designed to allow adult dependent relatives of British citizens living in the UK, persons with indefinite leave to remain (ILR), persons with refugee status or humanitarian protection leave (visa) or persons with Pre-Settled Status, to enter and settle (live permanently) in the UK.

The adult dependent relative must be able to demonstrate to the UK Visas and Immigration (UKVI) that, as a result of age, illness or disability, they require the day to day care of their UK based relative.

Requirements for an Adult Dependent Relative visa

To succeed in an application for an Adult Dependent Relative visa, you must be able to show the UKVI that:

  • You are agreed 18 years or over;
  • Your are the parent, grandparent, brother, sister, son or daughter of your UK based relative;
  • Due to age, illness or disability, you require long-term care of your UK based relative;
  • You are unable to secure the necessary long-term care in your country of residence even with the financial help of your UK based relative;

Your UK based relative is able to adequately maintenance, accommodate and care for you without recourse to public funds (benefits).

  • Your long-term care must be required to help you perform everyday tasks such as washing, cooking, dressing and cleaning;
  • You must be unable to dress, wash, cook and clean without help;
  • Your long-term care needs can due to long-term illness or a recent serious accident or illness;
  • Your required Long-term care will be assessed with reference to your specific needs;

In deciding availability of long-term care, the UKVI will consider:

  • whether your physical, emotional or psychological needs prevents you from performing your everyday tasks independently;
  • whether the long-term care your UK based relative provides is at the level that allows you to perform your everyday tasks;
  • Whether the required level of long-term care is available or accessible to you in your country of residence;
  • Applications for Adult Dependent Relative Visa must usually be made from outside the UK.
  • Successful Applicants (from outside the UK) will be granted indefinite leave to enter (ILE or Permanent Residence).

If you are inside the UK and you require long-term care of a UK based relative:

  • You can submit a Human Rights application for leave to remain (UK Visa) on the basis of your dependence on your UK based relative;
  • You will still need to satisfy all the requirements of an application for Adult Dependent Relative Visa (see above);
  • If successful, you will be granted Leave to Remain (UK Visa) on the basis of compelling and compassionate circumstances;
  • Your Visa will be valid for a period of 30 months (2.5 years)which can be extended;
  • Once you complete 10 years of residence in the UK, you will be granted indefinite leave to remain (ILR).
