What is an Administrative Review?

Administrative review forms an important part of the UK immigration framework, allowing applicants to challenge certain decisions made by the Home Office. Where an applicant believes that a decision on their visa application is incorrect, they may be entitled to request an administrative review. However, such a request can only be made on the basis that the decision was affected by one or more caseworking errors, as defined within the Immigration Rules. Understanding the UK Student Visa

The Student Visa serves as the primary immigration route for international students wishing to undertake an approved course at a licensed UK institution. It enables students not only to study but also to experience life in one of the most academically diverse and culturally rich countries in the world.

In recent years, the application process has been streamlined under the UK’s points-based immigration system, creating a unified framework where EU, EEA, and non-EEA applicants are assessed under the same criteria. This ensures consistency, transparency, and fairness across all applications.

A key requirement is securing an offer from a recognised UK education provider. Once accepted, the institution will issue a Confirmation of Acceptance for Studies (CAS)—an official reference that confirms your place and forms the foundation of your visa application.

Who Can Apply

The Student Visa is available to individuals who have been formally accepted onto a course by a licensed sponsor and issued a valid CAS. It caters to a wide spectrum of academic pathways, including:

  • Undergraduate and postgraduate degree programmes
  • Foundation and pathway courses designed to prepare students for higher education
  • Pre-sessional English language courses
  • Advanced academic routes such as doctoral programmes and extension schemes

Students aged 16 or 17 studying at independent schools may fall within either the Student Visa or Child Student Visa categories, depending on the nature and level of their course.

For shorter study periods, alternative visa options may be more appropriate. Courses lasting up to six months are generally covered under the Visitor Visa, while English language courses between six and eleven months fall under the Short-Term Study Visa route.

In certain circumstances, eligible students may also be permitted to bring dependants, allowing families to remain together during the course of study.

Course Requirements

To qualify for a UK Student Visa, you must hold an unconditional offer from a licensed student sponsor. Following acceptance, your institution will provide a CAS reference number, which must be used when submitting your visa application within six months.

The course itself must meet specific academic and regulatory standards. Eligible courses include:

  • Full-time programmes below degree level (RQF Levels 3–5), often focused on foundational or vocational training
  • Degree-level and postgraduate courses (RQF Levels 6–8), including bachelor’s, master’s, and doctoral qualifications
  • Part-time postgraduate programmes at an advanced level
  • Recognised foundation programmes for medical and dental professionals
  • English language courses meeting at least CEFR Level B2

Additionally, certain unique academic roles and pathways—such as student union sabbatical positions or postgraduate medical training following a UK degree—may also qualify under this visa route.

Required Documents

Parental Consent (Under 18s)

  • The visa application itself
  • The student’s living and care arrangements while in the UK
  • Travel to and from the UK

Supporting documentation, such as a birth certificate, is required to verify the relationship.

Bringing Dependants

While the Student Visa does allow dependants in certain cases, eligibility is carefully defined. Typically, this option is available to:

  • Government-sponsored students enrolled in courses lasting longer than six months
  • Students undertaking postgraduate research programmes of at least nine months

Dependants may include a spouse, civil partner, long-term partner, or children under the age of 18. Applicants may need to demonstrate that relationships are genuine and ongoing, and in the case of children, provide compelling reasons for their residence in the UK.

English Language Requirements

A strong command of the English language is essential for academic success in the UK. Applicants must demonstrate proficiency in reading, writing, speaking, and understanding English.

  • Degree-level courses require at least CEFR Level B2
  • Courses below degree level require at least CEFR Level B1

This requirement is typically met through an approved Secure English Language Test (SELT), although exemptions may apply for nationals of certain English-speaking countries or individuals with relevant academic qualifications taught in English.

Visa Curtailment

If your educational sponsor withdraws their support—whether due to non-attendance, academic issues, or other reasons—your visa may be shortened, usually to a 60-day period.

During this time, you must either leave the UK or secure a new sponsor and submit a fresh application. Visa curtailment can have long-term implications, making it important to act promptly and seek professional guidance where needed.

Switching to a Student Visa from Within the UK
