UK Student Dependant Visa
For international students embarking on an academic journey in the United Kingdom, the ability to remain close to loved ones is often just as important as the education itself. The UK Student Dependant Visa is designed to support this need, offering a structured and carefully regulated pathway for partners and children to accompany or join a student during their period of study.
This route not only allows families to stay together, but also enables them to share in the experience of living in one of the world’s most dynamic and culturally diverse countries—providing stability, continuity, and an enhanced quality of life throughout the student’s academic journey.
The requirements for a Student Dependent Visa can vary depending on your individual circumstances. For tailored guidance, it is advisable to seek expert advice from a qualified immigration lawyer.

What is an Administrative Review?
Administrative review forms an important part of the UK immigration framework, allowing applicants to challenge certain decisions made by the Home Office. Where an applicant believes that a decision on their visa application is incorrect, they may be entitled to request an administrative review. However, such a request can only be made on the basis that the decision was affected by one or more caseworking errors, as defined within the Immigration Rules. Upon submission of an administrative review request, the Home Office will reconsider the decision. This reassessment is conducted by a different caseworker or team from the one responsible for the original decision. If an error is identified during this process, the Home Office will amend the decision accordingly.

Who Can Bring Dependants to the UK?
The UK’s immigration framework places clear emphasis on ensuring that only eligible students are permitted to bring dependants, reflecting both policy priorities and the need to maintain sustainable migration routes.
You may be eligible to bring family members to the UK if you meet one of the following criteria:
- You are undertaking a full-time postgraduate course at RQF Level 7 or above that lasts at least nine months
- You are a government-sponsored student enrolled on a course exceeding six months
For courses commencing on or after 1 January 2024, the requirements have become more selective. In most cases, the course must be at doctoral level (RQF Level 8), such as a PhD or another research-intensive qualification. This reflects a targeted approach to attracting highly specialised academic talent.
Students who do not meet these criteria may still have limited eligibility in specific circumstances, particularly where transitional provisions apply or where dependants are already in the UK under a previous grant of leave.
Who Qualifies as a Dependant?
The Student Dependant Visa is intended for immediate family members, recognising the importance of close personal relationships in supporting a student’s wellbeing and success.
Eligible dependants typically include:
- A spouse, civil partner, or long-term unmarried partner
- Children under the age of 18
For partners, the relationship must be genuine, ongoing, and comparable to a marriage or civil partnership. Applicants must also demonstrate a clear intention to live together throughout their stay in the UK.
For children, the rules are more detailed, reflecting safeguarding considerations. A child may apply where:
- Both parents are applying together or are already present in the UK, or
- One parent is in the UK and the other is applying to join them
In more complex situations, a child may still qualify where there are compelling or exceptional circumstances—for example, where one parent has sole responsibility, or where only one parent is living.
Children over the age of 18 are generally not eligible to apply as new dependants. However, those already in the UK under this route may extend their stay, provided they continue to meet the requirements and apply before their current visa expires.
Application Process
The application process for a Student Dependant Visa is designed to be straightforward in structure, yet it demands careful preparation and attention to detail.
Applications may be made either from outside the UK (as entry clearance) or from within the UK (as permission to stay). In both cases, applicants must:
- Complete a detailed online application form
- Submit all required supporting documentation
- Pay the relevant visa application fee and Immigration Health Surcharge
- Attend a biometric appointment to provide fingerprints and a photograph
Once a decision has been made, applicants are formally notified by UK Visas and Immigration (UKVI). Successful applicants are typically issued with a Biometric Residence Permit (BRP) or digital immigration status, which must be collected or accessed shortly after arrival.
Dependants may apply at the same time as the main applicant or at a later stage, depending on personal circumstances.
Required Documents
A successful application relies on presenting a clear, credible, and comprehensive portfolio of supporting documents. These documents must demonstrate identity, relationship, financial capability, and overall eligibility.
Core documents include:
- A valid passport or recognised travel document
- Evidence of the relationship to the main applicant (such as a marriage or birth certificate)
- Proof that financial maintenance requirements are met
- Confirmation of the student’s enrolment, where applications are made separately
- Tuberculosis (TB) test results, where applicable
- A Biometric Residence Permit, for applicants already in the UK
For partners, additional evidence is required to demonstrate the authenticity and continuity of the relationship. This may include:
- Marriage or civil partnership certificates
- Proof of cohabitation over a sustained period (typically at least two years for unmarried partners)
- Joint financial records, tenancy agreements, or official correspondence
- Evidence of ongoing communication where the couple has lived apart
For children, documentation must confirm both the relationship and the child’s dependency status. This may include:
- Birth or adoption certificates
- Evidence that the child is not living an independent life
- Proof of living arrangements and parental responsibility
Where a child is living separately for educational reasons, formal confirmation from their school or institution must be provided.
All documents submitted in languages other than English or Welsh must be accompanied by certified translations.
Processing Times
Processing times can vary depending on where the application is made and the level of service selected.
- Applications from outside the UK are typically processed within up to 12 weeks
- Applications made within the UK generally take around 8 weeks
Priority and super-priority services may be available, offering significantly faster decisions—often within 5 working days or as quickly as 24 hours.
Duration of Stay
The length of a dependant’s visa is intrinsically linked to that of the main student applicant. In most cases, dependants are granted leave for the same duration as the student’s course.
For children, the visa duration may be aligned with the parent who has the shorter period of leave, ensuring consistency across family members.
Financial Requirements
Applicants must demonstrate that they have sufficient financial resources to support their dependants throughout their stay in the UK.
The required funds are calculated monthly, for up to nine months:
- £845 per month for students based in London
- £680 per month for students based outside London
These funds must be held in a bank account for a minimum of 28 consecutive days prior to the application.
This requirement is designed to ensure that dependants can be adequately supported without reliance on public funds, which are not accessible under this visa route.
Benefits of the Student Dependant Visa
The Student Dependant Visa offers both practical and emotional benefits. It allows families to remain united during a significant period of academic and personal development, reducing the challenges associated with long-term separation.
Key advantages include:
- The ability for adult dependants to work in most roles within the UK
- Access to high-quality education for children
- The opportunity to integrate into UK society and experience its cultural and professional landscape
For many families, this visa transforms the experience of studying abroad into a shared journey rather than an individual one.
Pathway to Settlement
While the Student Dependant Visa does not independently lead to settlement, it can form part of a longer-term immigration strategy.
If the main applicant later transitions into a visa route that leads to Indefinite Leave to Remain (ILR), their dependants may also qualify, provided they meet the relevant residence and eligibility requirements.
Achieving ILR removes immigration restrictions, allowing individuals to live and work in the UK freely and independently.
Common Reasons for Refusal
Despite its structured framework, applications may be refused if they fail to meet the required standards. Common reasons include:
- Incomplete or inconsistent documentation
- Errors or omissions in the application form
- Insufficient evidence of a genuine relationship
- Failure to meet financial requirements
- Non-disclosure of relevant immigration or criminal history
Given the importance of accuracy and completeness, careful preparation is essential. A well-documented and clearly presented application not only strengthens credibility but also significantly improves the likelihood of a successful outcome.
