Overview of the Start-up Visa

The Start-up Visa was designed for first-time entrepreneurs who wanted to establish a business in the UK. It was aimed at individuals with strong business ideas but without the need for initial investment funding or prior business experience.Although no investment funds were required, applicants needed to present a business idea that was innovative, viable, and capable of growth. This idea had to be assessed and approved by an authorised endorsing body.

The visa was granted for a period of two years and did not directly lead to settlement. However, visa holders could switch into the Innovator route, which could lead to indefinite leave to remain after a further three years.Start-up visa holders were also permitted to bring their partner and children under the age of 18 to the UK.

Who the Start-up Visa Was Suitable For

The Start-up Visa was intended for early-stage entrepreneurs with high-potential business ideas who were looking to establish a business in the UK for the first time. In most cases, applicants were expected not to have already begun trading in the UK. If any business activity had taken place, it needed to be at a very early stage and not yet operational.

This route was generally not suitable for:

  • Experienced entrepreneurs looking to scale an established business
  • Individuals wishing to join an existing UK company
  • Investors seeking to place funds into an already trading business

In these situations, alternative visa routes such as the Innovator Founder Visa or Skilled Worker visa would typically be more appropriate.

Eligibility Requirements

To qualify for a Start-up Visa, applicants needed to meet several key requirements set by UK Visas and Immigration.

Applicants had to:

  • Be at least 18 years old
  • Be starting a business in the UK for the first time
  • Have a business idea endorsed by an approved UK endorsing body
  • Apply within 3 months of receiving the endorsement
  • Intend and be able to carry out the proposed business activity
  • Meet the English language requirement at CEFR level B2
  • Show sufficient funds to support themselves in the UK (if required)

Applicants also needed to demonstrate a genuine intention to develop their business and spend the majority of their working time on it.

Financial Requirements

There was no requirement to invest a specific amount of money into the business. However, applicants were still expected to show that their business idea was realistic and capable of growth. In practice, this often meant having access to some level of funding, particularly where required by the endorsing body.

Applicants also needed to show personal savings of at least £1,270 to support themselves, with additional funds required for any dependants. These funds had to be held for a continuous 28-day period before applying.

Endorsement Requirements

A central part of the application process was securing an endorsement from an approved body. This organisation would assess whether the business idea met the required standards.

To be endorsed, the business needed to satisfy three key criteria:

  • Innovation: The idea had to be original and offer something new or improved in the market
  • Viability: The applicant needed to demonstrate the skills and knowledge required to run the business
  • Scalability: The business needed to show potential for growth and job creation

The endorsing body also needed to be satisfied that the applicant would dedicate most of their time in the UK to developing the business.

Applying as Part of a Team

Applicants did not need to start a business alone. It was possible to apply as part of a team, with multiple founders working on the same business idea.However, each individual applicant was required to obtain their own endorsement and submit a separate visa application.

Endorsement Letter

If an endorsing body approved your business idea, you would receive an endorsement letter. This was a key document and had to be included with your visa application.

The letter needed to meet specific Home Office requirements and include detailed information about both the applicant and the proposed business. Ensuring that this document was correctly prepared was essential to a successful application.

Switching into the Start-up Visa

While most applications were made from outside the UK, it was possible to switch into the Start-up Visa from within the UK, provided certain conditions were met. Switching was not permitted from some visa categories, including:

  • Visitor visas
  • Short-term student visas
  • Seasonal worker visas
  • Domestic worker visas

Applicants needed to hold an eligible immigration status in order to switch successfully.

Duration and Next Steps

The Start-up Visa was granted for a maximum of two years and could not be extended.However, before the end of this period, visa holders could apply to switch into the Innovator route. This allowed them to continue developing their business and, if successful, apply for settlement after a further three years.
