Representative of an Overseas Business Visa

OVERVIEW

Difference Between the Representative of an Overseas Business Visa and the UK Expansion Worker Visa

The Representative of an Overseas Business visa is often compared with the UK Expansion Worker visa, but the two routes serve distinct purposes. The UK Expansion Worker visa is intended for senior employees of overseas companies looking to establish a UK branch or subsidiary where no trading presence currently exists. This route is temporary and focuses on business expansion.

In contrast, the Representative of an Overseas Business visa is tailored specifically for media representatives on long-term assignments. It does not require the establishment of a UK entity and is designed for ongoing operational roles rather than setup activities.

There are also key differences in eligibility and requirements:

  • The UK Expansion Worker visa requires employer sponsorship, a valid sponsor licence, and a Certificate of Sponsorship
  • Applicants must meet minimum salary thresholds and work in an eligible occupation
  • The Representative visa does not require sponsorship or a minimum salary level

In terms of duration:

  • Representative visa holders can stay for up to 3 years, extendable by 2 years, and can apply for settlement
  • Expansion Worker visa holders can stay for up to 2 years in total and cannot directly qualify for settlement

Eligibility Criteria for the Representative of an Overseas Business Visa

To apply for this visa, applicants must meet specific eligibility requirements:

  • Be aged 18 or over
  • Be employed by an overseas newspaper, news agency, or broadcasting organisation
  • Have been recruited and employed outside the UK
  • Intend to work full-time as a UK-based representative
  • Work for a company whose headquarters and principal place of business remain outside the UK

Unlike other visa routes, media organisations can appoint multiple representatives in the UK simultaneously.

Financial Requirements for Applicants

There is no fixed financial threshold for this visa. However, applicants must demonstrate that they can adequately maintain and accommodate themselves and any dependants in the UK without relying on public funds. This is typically evidenced through personal bank statements and financial documentation.

English Language Requirements

Applicants may need to demonstrate their English language proficiency by:

  • Passing an approved English test at CEFR level A1 (speaking and listening), or
  • Holding a recognised academic qualification taught in English

Nationals of majority English-speaking countries are exempt from this requirement.

Required Documents for a UK Representative of an Overseas Business Visa

When applying, you will need to prepare a comprehensive set of supporting documents, including:

  • A valid passport or travel document
  • A detailed overview of the overseas company’s operations, finances, and structure
  • A formal letter from your employer confirming your appointment as their UK representative
  • Evidence of personal savings to support yourself in the UK
  • Proof of relationship for any dependants (e.g. marriage or birth certificates)
  • Tuberculosis test results (if applicable)
  • Details of your UK accommodation (for applications made outside the UK)

Providing clear and well-structured documentation is essential to avoid delays or refusals.

Visa Processing Times

You can apply for the visa up to three months before your intended start date in the UK. Typical decision times are:

  • Around 3 weeks for applications made outside the UK
  • Up to 8 weeks for applications made within the UK

Priority services may be available in some locations.

Visa Duration, Extensions, and Switching Options

Successful applicants are granted an initial stay of up to 3 years in the UK. You may apply to extend your visa for a further 2 years, provided you:

  • Continue working for the same overseas employer
  • Remain in a full-time representative role
  • Demonstrate that the business continues to operate primarily outside the UK

Applications for extension must be submitted before your current visa expires.

Bringing Dependants to the UK

This visa allows you to bring eligible dependants, including:

  • Your spouse or partner
  • Children under 18
  • Children over 18 already in the UK as your dependants

Each dependant must submit a separate application and provide evidence of their relationship to you. Partners must show proof of a genuine and ongoing relationship, while children must demonstrate financial dependency and that they are not living independently.

Dependants are permitted to:

  • Work in the UK (with limited restrictions)
  • Study
  • Travel freely in and out of the UK

However, they are not eligible for most public funds or benefits. After 5 years in the UK, dependants may also apply for settlement, subject to meeting the relevant requirements.

Permitted Activities and Restrictions

Under the Representative of an Overseas Business visa, you are permitted to:

  • Work solely for your overseas employer as their UK representative
  • Study alongside your role, provided it does not interfere with your work

You are not permitted to:

  • Take on additional employment
  • Engage in self-employment or business activities outside your role
  • Access public funds

Settlement in the UK (Indefinite Leave to Remain)

One of the key advantages of this visa is the pathway to permanent residence in the UK.

After 5 years of continuous residence, you may apply for Indefinite Leave to Remain (ILR), provided you:

  • Continue working for your overseas employer
  • Demonstrate an ongoing need for your role
  • Have not exceeded 180 days outside the UK in any 12-month period
  • Meet the English language requirement at CEFR level B1
  • Pass the Life in the UK Test

Time spent on this visa can be combined with similar representative visa categories, provided all conditions have been met throughout.
